We work with all types of estate planning needs, but our primary practice area / our focus is specializing in estate and business planning combined assuring that the two work together for transition planning, fair and equitable distribution, and estate tax planning. Zenk has over 20 years of experience working primarily with farming operations, land owners, and family business operations (construction companies, manufacturing companies, etc.) that have a particular exposure to “threats” at death that are unique compared to other estates: i.e. the estate plan is not aligned with the business transition plan which dismantles the generational business transfer intended, and estate taxes, both state (Minnesota) and federal. Those threats can end severely hinder the business operations or worse yet, end the operation all together. Why? These operations are primarily comprised in equity assets (i.e. farmland, equipment, commercial property), which are significant in value, but are integral to the business needs for continued operation. Where does the cash come from to pay for the estate tax? The equity assets, which cannot be sold and are needed for the continued operation of the business. Forced sales, borrowing against the assets, etc., can devastate, even end a business. The legacy you want to pass on exposed. There are tools to help plan for this, but it takes the action to get it done, and get it done right. This is our focus - our specialty.
